TRADEMARK RECORDATION

• Application Process

The Application is done in writing by filing FFC Form No.1 of The Merchandise Marks (Recordation) (R.E 2025).

The information to be filed in the form are as follows:

1. Particulars of the applicant including the full name, business address and telephone number.
2. Nationality of the trademark owner, or in case of a partnership, the nationality of each partner, or in case of an association or corporation, the country or jurisdiction of incorporation.
3. Place of manufacture of goods bearing the trademark.
4. Sample of the trademarked goods or a sufficient digital photographic representation of the trademarked goods with appropriate details for identification and differentiation from any counterfeits.
5. Names and business addresses of any foreign person or entities licensed to use the trademark, and the nature of such authorised use.
6. Particulars of any parent, subsidiary, or affiliated companies under common ownership or control that use the trademark abroad.

• Supporting Documents

1. Certified copy of the current trademark registration issued by the relevant registration authority, showing title in the name of the applicant
2. Proof of payment of application fees.

• Timelines

1. Twenty-One (21) days for the Chief Inspector to review the application and Five (5) days after the determination notify the applicant.
2. Recordation becomes effective on the date the application is approved by the Chief Inspector.
3. Renewal of Recordation Thirty (30) days before expiry of the Recordation.

• Validity of the Recordation

Recordation shall remain valid for one year from the date of approval. After one year it needs to be renewed, or it will be deemed cancelled.

• Renewal of Recordation

The owner of a recorded trademark shall apply for renewal not later than thirty (30) days before the expiry of recordation.

• Cancellation of the recordation

Recordation is deemed cancelled when the trademark registration is revoked, cancelled, or the recordation is not renewed.

• Applicable Fees

1. Application to record Trademarks – Tshs 200,000.00
2. Change of Ownership- Tshs 100,000.00
3. Renewal of Recordation- Tshs 50,000.00
4. Application for Search- Tshs 3,000.00
5. Application for Copies-Tshs 3,000.00
